In the 1934 U.S. Supreme Court case of Home Building & Loan Association v. Blaisdell, Supreme Justice Charles Evans Hughes took note of the economic conditions of the Great Depression in order to conclude a state of emergency, which allowed the State of Minnesota to properly enforce contracts entered into by individuals to promote a broad social interest. In particular, the court upheld a Minnesota statute that prevented credit companies from auctioning homes before 1935, although corporate mortgage contracts have the right to do so. Legal activism is the exercise of the judge`s appreciation to annul government acts. In general, the expression is used to identify undesirable exercises of this power, but there is little consensus on which cases are not desired. In the way the notion of legal activism is usually used, justice activists abandon their responsibility in interpreting the Constitution and instead decide on cases to advance their preferred policy. However, there is little consensus on the decisions that fit this description. Years. (i) discipline discipline is obedience, application and the outward sign of respect.
This means obedience to the rules of the organization, both on the part of superiors and subordinates. Discipline is necessary for the smooth running of the organization. According to Mr. Fayol, „discipline requires good superiors at all levels, a clear and fair agreement and a reasonable application of sentences.“ Discipline means not only rules and rules, but also the development of staff engagement with the organization and each other. For example, in XYZ Ltd, management and the union reached an agreement in which the workers agreed to restart the business from losses. In return, the management would increase the wages of the workers. Here, „discipline“ means that workers and management are delivering on their commitments. (ii) Unity of Command A subordinate should only receive orders from a supervisor at a given time. According to this principle, a subordinate should only receive orders from a hierarchical superior at a given time. The principle is necessary to avoid confusion and conflict. For example, when a subordinate receives orders from more than one supervisor in an organization, he cannot properly execute several orders and is therefore not able to satisfy his superiors.
The subordinate would be in a confused state, what commands should be The principle of the unity of the command was shown in the following graph: Years.
